HOW TO ENTER

The odds of winning depend upon the number of eligible entries received and/or the number of people participating in each sweepstakes.

Only one (1) entry per person per sweepstakes.  Only one (1) entry per household per sweepstakes.  Winners are not eligible to participate in any Global Jazz, Inc./KKJZ Fundraising, Inc. sweepstakes for a period of sixty (60) calendar days from the date of qualifying for or winning a sweepstakes conducted or sponsored by Global Jazz, Inc. or KKJZ Fundraising, Inc.  By entering any of the below sweepstakes, each participant hereby agrees that such participant has read and will be bound by these official rules.

Participants and winners must be legal residents of United States and at least eighteen (18) years or older as of the date and time of entering any sweepstakes, with the exception of the Windrose Jazz Cruise (more details provided below). Winners acknowledge that if they enter any Global Jazz, Inc./KKJZ Fundraising, Inc. sweepstakes under a fraudulent name, they will automatically be disqualified from the sweepstakes and any future sweepstakes on KKJZ 88.1 FM, www.jazzandblues.org, or any other station or website affiliated with Global Jazz, Inc. or KKJZ Fundraising, Inc.  Employees of Global Jazz, Inc., KKJZ Fundraising, Inc., their affiliates, their representatives, the sweepstakes’ participating sponsors and their underwriting/advertising agencies, employees of any other broadcast company serving Southern California, and members of the immediate families of such persons and any individuals who have been employed by Global Jazz, Inc. or KKJZ Fundraising, Inc. in the sixty (60) calendar day period immediately preceding the effective date of the sweepstakes are ineligible to participate or win.  The term “immediate family” includes spouses, domestic partners, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.  Residents of New York, Rhode Island, the District of Columbia, and Florida, and non-United States residents are ineligible.

Void where prohibited.  The sweepstakes are subject to all federal, state, and local laws.

iPHONE/iPOD TOUCH WEB-ONLY SWEEPSTAKES (2)

Prize Description: Two (2) iPhones with 3G, courtesy of KJAZZ.  Both winners will have the option to substitute an iPod Touch with 8GB as their prize. LONG BEACH BLUES FESTIVAL EARLY BIRD SWEEPSTAKES

Prize Description: One (1) winner and their guest will be the first two people allowed onto the Festival site on September 5 and 6 and allowed to choose their spot within their ticket section (e.g., if the winner has a Buddy Pack that winner will be allowed to choose the first spot within the GA section; if the winner has a Platinum Passes that winner will be allowed to choose the first spot within the VIP section).  In the event the winner does not have general admission tickets or a VIP package to the Long Beach Blues Festival, the winner also will receive one (1) pair of GA weekend passes.  Prize value: priceless.  The sweepstakes start date is May 27, 2009 at 12:01 a.m. Pacific Time and the end date is June 7, 2009 at 11:59 p.m. Pacific Time.  All individuals who contribute during the above sweepstakes period for a VIP package to the 2009 Long Beach Blues Festival will automatically be entered into the sweepstakes.  The odds of winning depend upon the number of entries received and/or the number of people participating in the sweepstakes.

2009 SUMMER GRAND PRIZE SWEEPSTAKES – THAILAND GETAWAY ADVENTURE

Prize Description: One (1) seven (7) day, six (6) night trip for two to Thailand.  The prize includes roundtrip coach airfare for two (2) from LAX to Bangkok, Thailand on EVA Air, courtesy of EVA Air, and a land package, provided by the Tourism Authority Thailand.  The prize also includes two (2) night hotel stay at the Amari Watergate Hotel; a tour of the Canal & Royal Grand Palace with lunch; two (2) domestic coach air tickets on Thai Airways from Bangkok to Chiang Mai; two (2) domestic coach air tickets on Thai Airways from Chiang Mai to Phuket; two (2) domestic coach air tickets on Thai Airways from Phuket to Bankgok; two (2) night hotel stay at the Empress Chiang Mai Hotel; an elephant show; bamboo rafting with lunch; two (2) night hotel stay in Phuket at the Amari Coral Beach Resort; a full day James Bond Island tour and lunch; two (2) tickets to the Phuket Fantasea Show; dinner at the Grand International Buffet; six (6) American breakfasts; meet and greet by a tour guide; and airport transfers.  The winner must complete the entire trip before June 8, 2010.  The airfare from EVA Air has the following restrictions:  the routing is LAX-TPE-BKK; the two (2) tickets are valid for three (3) months after date of issue and the whole itinerary must be completed within three (3) months from the ticket issuing date; the reservation must be made with the EVA reservation department; seats are based on availability; the winner must present the original ticket certificate to the EVA LAX ticketing office to redeem the tickets. DRAWING AND PRIZE AWARD

For each sweepstakes, a random drawing will be made of all eligible, completed entries received during each Sweepstakes Period.  The winner will be selected within approximately seven (7) calendar days of each sweepstakes end date, unless noted otherwise for a particular sweepstakes.  Winners will be notified by telephone only.     

All prizes must be accepted as awarded.  Prizes are not transferable, redeemable for cash or exchangeable for any other prize.  All prizes must be redeemed within seven (7) calendar days of notification of winning, unless otherwise specified at the time of winning or unless otherwise specified for a particular sweepstakes.  If a winner fails to redeem a prize within 7 calendar days, the winner forfeits the prize, no other prize will be awarded in its place to that individual and Global Jazz, Inc. and KKJZ Fundraising, Inc. reserve the right to determine an alternate winner (in which case an alternate winner will be drawn randomly) or to not award that winner’s prize, in their sole discretion.  If a winner cannot be contacted by telephone or is disqualified, Global Jazz, Inc. and KKJZ Fundraising, Inc. reserve the right to determine an alternate winner (in which case an alternate winner will be drawn randomly) or to not award that winner’s prize, in their sole discretion.  Global Jazz, Inc. and KKJZ Fundraising, Inc. retain the right to substitute a prize with another similar prize of equal or greater value in the event the original prize offered is not available due to circumstances beyond Global Jazz, Inc.’s or KKJZ Fundraising, Inc.’s control.  In the event Global Jazz, Inc. and/or KKJZ Fundraising, Inc., as the case may be, elect to determine an alternate winner, pursuant to these rules, Global Jazz, Inc. and/or KKJZ Fundraising, Inc. will select up to three (3) alternate winners.  If the third alternate winner fails to redeem the prize within 7 calendar days, cannot be contacted by telephone, is disqualified, is unable to use the prize as awarded, or declines the prize, Global Jazz, Inc. and KKJZ Fundraising, Inc. reserve the right to determine an alternate winner through any method they deem appropriate, in their sole discretion.  Global Jazz, Inc. and KKJZ Fundraising, Inc. have no affiliation with and do not endorse any prize sponsors. 

Delivery of prizes: All prizes will be delivered to winners via United States Mail service, unless otherwise noted.  Prizes will be mailed within forty-five (45) calendar days after they have been awarded, unless otherwise noted. Global Jazz, Inc. and KKJZ Fundraising, Inc. are not responsible for any lost, stolen, misdirected or damaged mail.  Prizes lost or damaged in mailing will not be replaced.

Payment of taxes and related expenses: Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which are not expressly included as part of the prize. 

Required documentation: Winners of prizes with a fair market value of $600 or greater must execute and return an IRS Form W-9 and an affidavit of eligibility and liability release and must provide a photocopy of a legal document showing the winner’s social security number within seven (7) calendar days of receiving such forms or the prize will be forfeited and an alternate winner will be randomly selected from the remaining eligible entries.  Winners agree to accept the estimate of fair market value of the prize won.  Winners of prizes with a fair market value of less than $600 may be requested to execute and return an affidavit of eligibility and liability release and provide a photocopy of a legal document showing the winner’s social security number.  Where such forms and documents are requested, winners must execute and return such forms and documents within 7 calendar days of receiving the forms or the prize will be forfeited and an alternate winner will be randomly selected from the remaining eligible entries. 

Release of liability: All winners and their guests, by acceptance of any prize, agree to release and hold forever harmless Global Jazz, Inc., KKJZ Fundraising, In., all associated prize partners, their affiliated companies, their agents, officers, employees, affiliates and assigns for any injuries, accidents, misfortunes, or causes of action arising from or in connection with participation in any sweepstakes, acceptance of any prize, use of any prize, or while traveling to or from any prize related activity.  Winners shall bear all risk of loss or damage to prizes after receipt.  By accepting any prize, the winner consents to the  use (or non-use) of the winner’s and, if applicable, the winner’s guest’s name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and internet), for all legitimate business purposes including advertising and promotional activities and media and other activities and communications, unless prohibited by law, without further compensation. 

Under no circumstances shall participants be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and participants further waive all rights to have damages multiplied or increased.

If a concert, other ticketed event, gift certificate or coupon has been awarded as a prize and the concert, event, place of business, or product is postponed, rained out, cancelled or for other reasons beyond our control do not occur/exist, Global Jazz, Inc. and KKJZ Fundraising, Inc. will not be responsible for replacing the prize.  To the extent that any prize consists of airline tickets and/or hotel reservations, Global Jazz, Inc. and KKJZ Fundraising, Inc. are not responsible for any cancellation, postponement, lost ticket or overbooking.

Global Jazz, Inc. and KKJZ Fundraising, Inc. have the sole discretion to terminate a sweepstakes at any given time or extend the dates of a sweepstakes.  Global Jazz, Inc. and KKJZ Fundraising, Inc. retain the right to amend these rules at any time for any reason. 

Global Jazz, Inc. and KKJZ Fundraising, Inc. reserve the right to substitute prizes of equal or greater value upon notice or change to the sweepstakes rules.  Any ties, disputes, conflicts, questions or concerns regarding Global Jazz, Inc.’s/KKJZ Fundraising, Inc.’s sweepstakes and/or their associated prizes will be handled by the Director of Marketing for Global Jazz, Inc., whose decisions are final and indisputable.

Choice of Law and Forum:  Any dispute arising out of or in connection with any of the sweepstakes and all issues and questions concerning the construction, validity, interpretation and enforceability of these rules shall take place in Los Angeles, California, U.S., in accordance with the laws of the State of California, without regard to conflicts of laws principles, and shall be referred to and finally resolved by a single arbitrator appointed under the rules, and in accordance with the procedures of the American Arbitration Association, which rules and procedures are deemed to be incorporated by reference into this section.

For sweepstakes with prizes involving travel: The winner and his/her guest(s), if any, agree to accept the travel dates specified in the sweepstakes.  If the winner cannot travel on such dates, the prize will be forfeited.  Winners agree to accept all blackout dates, space availability requirements, etc. established by Global Jazz, Inc.’s/KKJZ Fundraising, Inc.’s prize partner(s), such as hotels, airlines, trains, ships, etc.  The winner and his/her guest(s) that accept any trip as a prize do so entirely upon their own initiative, risk, and responsibility.  If the trip requires traveling outside of the United States, the winner, upon winning the prize, must have a valid US passport.  If the winner does not have a valid US passport upon winning the prize, the trip may be forfeited.  Where a prize allows for the winner to take guests, the guests must be eighteen (18) years of age or older except where the winner is the parent or legal guardian of the accompanying guest(s).  The winner’s guest(s) (parent or legal guardian, if a guest is a minor) also must complete an affidavit of eligibility and liability release, which must be returned with the winner’s affidavit of eligibility and liability release within seven (7) calendar days of receipt of the forms or the prize will be forfeited and an alternate winner will be randomly selected from the remaining eligible entries.  No alternate guest(s) may be substituted once the winner’s guest(s) complete the required paperwork.  The winner and his/her guest(s) are solely responsible for obtaining all necessary travel documentation.  The winner and his/her guest(s) are solely responsible for all costs not expressly included in a prize including, without limitation, any applicable taxes, license fees, additional tours, additional transportation, fuel surcharges, currency charges, all meals, beverages, room service, gratuities, merchandise, medical services, additional lodging, replacement of any lost items, optional travel insurance, etc.  Airfare for winners will be provided from Los Angeles International Airport.  If any part of the trip's itinerary does not take place as planned, for any reason, beyond the control of Global Jazz, Inc. or KKJZ Fundraising, Inc., including but not limited to, cancellation, scheduling conflicts, political conflicts or war or an event of force majeure, the remaining components of the prize will be awarded and Global Jazz, Inc.’s and KKJZ Fundraising, Inc.’s obligation to the winner will be fulfilled, and no other additional compensation will be provided.

Web-only sweepstakes and web entries for sweepstakes: To enter a sweepstakes on Global Jazz, Inc.’s/KKJZ Fundraising, Inc.’s website, participants must complete all the information deemed necessary to declare a winner.  Global Jazz, Inc. and KKJZ Fundraising, Inc. do not assume any liability for any malfunction of the internet or individual computer systems, servers, access providers, computer equipment, software, or for failure of any email or entry to be received on account of traffic congestion on the internet or at www.jazzandblues.org, or any combination thereof including any injury or damage to an participant’s or any other person's computer related to or resulting from downloading any material related to the above sweepstakes.  If an entry is illegible or does not supply all information deemed necessary to declare a winner, the entry will be deemed invalid and another entry will be selected.  In the case of dispute as to the identity of any online entrant, entry will be declared made by the authorized account holder of the email address submitted at the time of entry.  As used in these sweepstakes, "Authorized Account Holder" is defined as the natural person who is assigned an email address by an internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Global Jazz, Inc. and KKJZ Fundraising, Inc. with proof that such winner is the authorized account holder of the email address associated with the winning entry.
